This Yard Placement Agreement (“Agreement”) outlines the responsibilities and expectations for outdoor structure delivery and yard placement services arranged by Gone Broody (“Company”) and carried out by an independent third-party provider. By signing this Agreement, the Customer acknowledges and agrees to the terms outlined below and understands that yard placement is performed by a separate company coordinated by Gone Broody.

1. Customer Responsibilities Before Delivery

To ensure a smooth and successful delivery, the Customer is responsible for preparing the site and access path ahead of time and responsible for sending photos of the cleared delivery path prior to scheduling delivery.

Required preparations include:

Removing any fencing, gates, or obstructions in the delivery path.
Ensuring the access path is at least 2 feet wider than the widest point of the structure.
Clearing the path of any:
Low-hanging branches (may need up to 13 feet clearance for some structures)
Bushes or shrubs
Power lines
Steep hills, ditches, or uneven terrain
Clearly marking all underground utility lines, sprinkler lines, and invisible fences.
Submitting the following photos in advance:
Final destination for the structure
Full delivery path
Any potential obstacles or hazards
Preparing any required foundation (foundation work is not provided by the Company).
Informing us of any special conditions (such as anchored structures, interior finishes, etc.).

If these conditions are not met, the delivery may be delayed or result in additional fees.

2. Changes and Special Requests

The following require written approval and at least one week’s notice:

Changing the agreed delivery or placement location (even if it’s in the same yard). A new address will require a full reevaluation and may change the original quote.
Requesting to reschedule with short notice (same-day changes or less than one week notice)
Asking delivery crews to proceed with unsafe or blocked access

Unsafe or blocked access shall be determined solely at the discretion of the delivery crew and/or Gone Broody based on safety standards and equipment limitations.

3. Possible Additional Charges

Additional charges may apply if:

The structure has interior finishes that weren’t disclosed. Interior finishes include, but are not limited to, interior paneling, shelving, electrical components, insulation, built-in furniture, or any item permanently affixed inside the structure.
The structure is anchored or bolted down, and this wasn’t shared ahead of time
The structure is not emptied before the move, risking damage
Crews must wait on-site for site readiness ($75 per 15-minute interval)
The destination or access path differs from what was initially provided (requires 1 week notice with approval)
Unexpected obstacles are encountered during delivery
If access is blocked or unfit, a $299 “Attempt to Move” fee will be charged

By signing this agreement, the Customer agrees to the $299 Attempt to Move fee in cases where access is deemed unfit or unsafe upon arrival. This fee covers equipment mobilization, driver time, and scheduling costs.

4. Relocation or Site Prep (if applicable)

If relocating a structure:

Structure must be completely emptied
Water and electricity must be disconnected from the structure
Delivery path must be fully cleared
Foundation must be prepped before arrival
Photos must be submitted showing removed obstacles (e.g., fences, bushes)
Gate or access opening must be at least 48” wide (without steps) and 2 feet wider than the structure

5. Liability Statement

Gone Broody and its delivery partners are not responsible for:

Damage to grass, landscaping, sprinkler systems, invisible fences or unmarked underground lines
Structural damage caused during the move due to preexisting conditions
Leveling beyond standard four-corner support (foundation to be prepared by Customer prior to scheduling delivery)
Delays due to weather or unsafe delivery conditions

Gone Broody shall not be held liable for any damage, loss, or injury caused by the acts or omissions of third-party delivery or yard placement providers.

6. Permit Responsibility and Liability

The Customer is solely responsible for obtaining all necessary permits, approvals, and permissions required by their local municipality, village, township, or city for the delivery, placement, and use of any outdoor structure purchased through Gone Broody. The Company is not responsible for verifying local zoning regulations, setback requirements, or building codes.

Because all structures are custom built to order, returns, cancellations, or refunds will not be accepted if a permit is denied or not obtained. It is the Customer’s obligation to confirm compliance with all local regulations prior to placing an order. Gone Broody assumes no liability for any fines, delays, or removal costs resulting from unapproved or non-compliant installations.

7. Delivery and Yard Placement Timing

While Gone Broody makes every effort to coordinate delivery and yard placement on the same day, please note that the structure may be delivered on a different day than when it is placed in the yard. Delivery and placement are coordinated through third-party providers, and delays may occur due to weather, equipment availability, or other unforeseen circumstances.

Should any changes to the scheduled dates arise, the Customer will be notified immediately, as we understand how delivery timing can impact your work schedule and family plans. We appreciate your patience and flexibility in these situations.

8. Fence Removal and Site Preparation Assistance

If you prefer not to handle fence removal or site preparation on your own, you may consider hiring a professional service. One option is Handy Buddy, which connects customers with local professionals for tasks like fence removal, gate widening, and basic site preparation. You can learn more at: www.handybuddy.com

Please note that these types of service may not be available in all areas. You are also welcome to seek out local help through a handyman or contractor in your area.

Most yard placements are completed using a mule machine, which allows for maneuverability in tight spaces. For more complex or difficult deliveries, forklifts or cranes may be used as needed.

9. Customer-Provided Off-Loading Services

Customers may choose to provide their own off-loading services for the delivery of their outdoor structure. However, by electing this option, the Customer assumes full responsibility and liability for all aspects of the off-loading process.

This includes, but is not limited to:

Any damage to the structure during off-loading
Any damage to the delivery truck or equipment used by the shipping company
Any damage to the Customer’s property, driveway, lawn, or surrounding areas
Any additional time, labor, or coordination costs associated with the off-loading

Gone Broody and its shipping partners are not liable for any incidents, delays, or damages that occur during Customer-managed off-loading. Customers choosing this option do so at their own risk and expense.

10. Indemnification

Customer agrees to indemnify, defend, and hold harmless Gone Broody and its agents from any claims, damages, losses, or expenses (including attorney’s fees) arising out of or related to delivery, placement, or Customer-provided off-loading services.

11. Force Majeure

The Company shall not be liable for delays or failure to perform due to acts of God, labor disputes, road closures, natural disasters, equipment failure, or other events beyond its reasonable control.

12. Limitation of Liability

To the fullest extent permitted by law, the Company’s total liability for any claims arising out of or relating to this Agreement shall not exceed the purchase price of the structure.

13. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through binding arbitration in the state where Gone Broody is headquartered. Each party shall bear its own legal costs unless otherwise determined by the arbitrator.

Inspection Required at Delivery. You must inspect all items while they are still on the truck and before signing the delivery receipt. Any damage, shortage, or packaging concerns must be noted on the bill of lading and photographed. If the product is unloaded or a clean receipt is signed, the shipment is deemed accepted “as-is,” and damage claims or returns for transit-related issues will not be accepted, to the fullest extent permitted by law.

Site Readiness: Before scheduling delivery, please confirm site readiness by sending photos of any fencing removed to create an opening at least 2 feet wider than the structure, sharing photos showing obstacles have been cleared, trimming overhead branches, marking underground utility lines, and verifying the gate and access path are each at least 2 feet wider than the structure.

Support Boards, Cupolas, Netting, and External Lights: Some coops may arrive with temporary support boards attached to the chicken run. These boards are used to brace the structure during shipping and yard placement to prevent movement or damage. Once your coop is positioned, these boards are no longer needed and should be removed and disposed of by the customer. If your order includes a cupola, it will ship together with your coop but will not be attached. This is to ensure safe transport and proper clearance under bridges and overpasses. The cupola can be easily installed by the customer by screwing it onto the flat base provided on the roof. If external lights were purchased, these may also arrive detached to prevent damage during transit. They can be quickly and safely installed by the customer once the coop is set in place. If you have ordered shingles, netting or tarp may placed over them for protection during transport. It is the customer's responsibility to remove and discard the netting or tarp.
